I
am looking for the House of Lords case where one of their Lordships
(who I think is Lord Hoffmann) comments that in contrast to the
law of torts with its discrete torts and compartmentalized reasoning,
contract law has traditionally been viewed and interpreted as a
unitary whole -- the law of contract rather than a law of contracts.
I believe that the thrust of this comment was that this unitary
thinking might not always be appropriate given that certain types
of contracts are special in the civilian sense (i.e. that they have
idiosyncratic rules mandated by their special conceptual nature).
Any
assistance would be most appreciated.
