Subject: Further HCA case - care of prisoners

Sorry to be clogging up your email boxes - just thought I should mention that the HCA has also handed down another tort decision, New South Wales v Bujdoso [2005] HCA 76. The State was held liable for failure to adequately protect a prisoner who was known to be at risk of violence from other prisoners.

This one, believe it or not, is a joint decision of all 6 members of the Court who heard it, and goes the plaintiff's way!
