Dear Colleagues;
An interesting decision on private nuisance in Barr & Ors v Biffa Waste Services Ltd [2012] EWCA Civ 312 (19 March 2012)  http://www.bailii.org/ew/cases/EWCA/Civ/2012/312.html .
Holds that a waste management company can be liable in nuisance for emission of gross odours even though it complies with local planning regulations. Seems very sensible. Cites ODG member Murphy's Law of Negligence at [65].
