Dear Colleagues:
Congratulations go out to Ernest Weinrib, Angela Swan and Jakub
Admanski on the publication of two new books that will be of great
interest to ODGers.
In
Corrective Justice, Professor Weinrib "takes up and
develops his account of
corrective justice, its nature, and its role in understanding the
law. He begins by setting out the conceptual components of
corrective justice, drawing a model of a moral relationship between
two equals and the rights and duties that exist between them. He
then explains the significance of
corrective justice for various legal contexts: for the grounds of
liability in negligence, contract, and unjust enrichment; for the
relationship between right and remedy; for legal education; for the
comparative understanding of private law; and for the compatibility
of corrective justice with state
support for the poor.

the book contains a re-worked version of one of my all time
favourite essays, "Can Law Survive Legal Education?" , which I
highly recommend to anyone who has ever asked themselves what should
a law school be doing.
In
Canadian Contract Law, 3rd ed, Swan and Admanski, the
authors provide new analyses of good faith, damages, fundamental
breach and the task of interpreting contracts and implying terms.
As the back cover notes: "Underpinning the new edition, as with the
previous ones, is a focus on how individual cases illustrate and
illuminate the attitude that a court is likely to take to the
dispute before it." "The analysis of the cases and principles has
been developed to assist the solicitor as much as the barrister".
