Although it is only a first instance decision on a strike out application, the judgment of Edelman J in the Supreme Court of Western Australia in Nicholson & Ors v Morgan [2013] WASC 110 is certainly worth reading: http://www.austlii.edu.au/au/cases/wa/WASC/2013/110.html. Edelman J explores the elements of dishonest/knowing assistance after Farah Constructions, considering the relevance of the Baden scale of knowledge, and examines the differences between English and Australian law. As Edelman J notes, there may some further interesting issues if and when the case proceeds to trial.
