Jason
As noted in my previous e-mail the example was borrowed from Matthew,
who treated it as public policy (borrowing the language of the cases
on which he was working, I suspect) feel free to substitute a
different idea which you regard as 'public policy' and not a 'right'
if that will simplify the argument.
If all such values and value judgments can be pitched into the melting
pot of 'what justice requires' what is the substantive difference
between the approach of the 'strict legalist' and the approach of
someone who refers to public policy directly?
Is this a purely semantic dispute?
Perhaps the references you helpfully provided will answer this question for me.
