Subject: Irish High Court on Liability of Police in Negligence

The judgment of the Irish High Court in Kelly v Commissioner of An
Garda Siochana (Commissioner of the Police) was published today.

In brief, the Plaintiff, the husband of Ms. Kelly (deceased) sued the
police for negligence surrounding the granting of bale to her killer.
The argument was that had the police done their job properly, the
killer would not have been at large to kill Ms Kelly. This was an
application by the Commissioner to strike out the Plaintiff's claim.
Despite strong facts, the Court struck out the claim.
