Subject: Two Major UK Supreme Court decisions to be handed down next week

Dear Colleagues,

 

As many members prepare to visit Cambridge for Obligations VIII, the UK Supreme Court has indicated that it will decide two major private law cases next Wednesday: both are rare 9 Justice panels. One is Patel v Mirza (https://www.supremecourt.uk/cases/uksc-2014-0218.html), on illegality and locus poenitentiae (and perhaps broader considerations, like the state of the law, depending on the angle the court takes). The other is Willers v Gubay (https://www.supremecourt.uk/cases/uksc-2015-0154.html), on whether the tort of malicious prosecution embraces civil proceedings, and also wider questions about the precedential status of some Privy Council decisions. Members may recall that during the last Obligations conference in 2014, the Supreme Court gave judgment in FHR European Ventures, and so it is nice of the Justices to provide further topics for discussion at this year’s event.
