Subject: Woman Sues to Ban Neighbours from Cooking Spicy Food


For those getting ready for fall term, I thought the article below provide be a fun fact pattern for a nuisance and negligence question on the exam.

It appears a woman in a downstairs flat is suing to prevent her upstairs neighbour from cooking “hot chillis” because the fumes give her respiratory problems. She is also suing the landlord in negligence for failing to prevent her injuries after being told of the problem.
