Subject: Contract Damages and Assent

Dear Colleagues

I am working on a project having to do with damages and assent in contract. I have a number of cases that seek to explain the connexion, but many of these seem rather dated. It may be poor research skills but I am finding it a bit challenging to locate more modern discussions of the idea that contract damages are more limited than in tort because the parties have implicitly assented to limited recovery.

I’m particularly interested in cases from around the Commonwealth and articles on the subject as well. So, if you know of a good, recent case, I’d be grateful to have it. I’d also be grateful to have your articles on the subject. (Please don’t be afraid to self-promote.)

Any help would be greatly appreciated.
