The above event is a celebration of the recent publication of Niall Whitty's long-awaited magnum opus on the Scots law of unjustified enrichment. In some thousand pages Whitty considers
Scots law in its comparative context, featuring in particular English, German and South African law, and taking full account of the literature in all these jurisdictions as well as their case law and legislative provisions. The seminar will open with Whitty's
account of the issues to which he thinks his work gives rise, and there will then be four contributions from Helen Scott (on error and mistake), Jacques du Plessis (illegality), Sonja Meier (enrichment and contract) and Danie Visser (considering third ways
between the Civilian/Common law divide). This will be followed by open discussion for around half an hour, with the whole event being recorded.
