AFTER THE BIG BANG:
RESHAPING CENTRAL BANKING, REGULATION AND SUPERVISION


AIM:

After three editions (2006, 2007 and 2008), Finlawmetrics
has established itself as a unique forum for analysis and
discussion of the most relevant issues related to the
evolution of economics and law in the fields of central
banking, financial regulation and supervision. The
initiative is scientifically promoted by two leading
research centres: The Paolo Baffi Centre on Central Banking
and Financial Regulation (Bocconi University) and the
Center on Central Banks and Financial Institutions (New
York University).

With the financial crisis still raging through the markets,
the 2009 edition will address the multitude of new
questions that are emerging for the design of post-crisis
policies institutions.

The Steering Committee welcomes empirical, institutional
and comparative papers that shed light on the different
causes of and consequences for regulation and supervision
of the ongoing crisis.

TOPICS:

The Conference will focus on the relationships between
aspects of central banking, regulation and supervision on
one hand, and banking and financial markets, on the other
hand. Submissions by academics with a background in
economics and/or in law are welcome.

FORMAT:

Papers will be presented in session presentations of 30
minutes, followed by 15 minutes of comments by discussants
and an additional 15 minutes of plenary discussion. No more
than 16 papers will be presented and overall participation
at the workshop will be limited to 60 people.


PAPER SELECTION:

Authors are invited to submit completed papers
electronically (MS Word or PDF format). The first page of
the paper should contain the title; name of the author(s),
complete address, telephone, fax numbers and E-mail
addresses. All submitted papers must be accompanied by an
abstract of at least 250 words, but no more than 400.
Authors may also be asked to serve as session chair and/or

DISPUTES, TECHNOLOGY AND LAW:
EXPANDING THE BOUNDARIES OF ONLINE DISPUTE RESOLUTION

The 2009 International Forum on Online Dispute Resolution
Haifa, Israel June 3-4, 2009


The spread of digital technologies in recent decades has
transformed the field of conflict resolution. Whereas in
the past, institutions and processes for addressing
disputes were premised on physical presence and face-to-
face interaction, new mechanisms for addressing disputes
have emerged online. These processes - typically termed
Online Dispute Resolution (ODR) - were perceived initially
as an appropriate means for addressing simple disputes that
emerged online and for which traditional dispute resolution
avenues (courts or face-to-face ADR) were not available.
Nowadays, ODR has spread to additional domains such as
family disputes and peace building efforts, e.g. offline,
complex and emotional disputes, precisely those domains
originally perceived as inappropriate for ODR.

Consequently, ODR is no longer confined to the delivery of
processes of dispute resolution online but studies the role
and impact of technology on the emergence, transformation
and resolution of disputes. This broader understanding
covers such developments as Digital Courts and the
Transformation of the Legal Profession into the province of
ODR. The location of the conference provides a unique
setting for exploring these themes. Haifa, the third
largest city in Israel, is a center for IT development and
entrepreneurship and a unique locus in which people of
different religions and ethnic backgrounds live side by
side. Israel, more generally, is home of numerous
technological breakthroughs, but is also in the midst of a
long-lasting and bloody conflict with the Palestinian
population.


TOPICS:

The conference seeks to present a comprehensive view of the
field (in terms of practice and theory) and to reflect on
directions for future development and expansion in three
main areas - the business sector, the courts and the
international sphere. By bringing together academics and
professionals from diverse disciplines to discuss the
current state of ODR and its future evolution, we seek to
explore the following themes:

- Will ODR remain separate from ADR and courts?

- What lessons can we draw from the challenges of
traditional dispute resolution mechanisms in face of the
proliferation of digital technologies?

- Is ODR better suited to address technology-related
disputes?

- What norms should guide ODR processes in addressing
technology-related disputes in such areas as freedom of
speech, privacy and IP rights?

- What procedural values are and should be promoted by ODR
mechanisms?

- Who are the "old" (lawyers?) and "new" (ODR providers,
websites?) intermediaries of the contemporary dispute
resolution landscape and what role should they play?

- What role should regulation occupy in the development of
ODR?

- What are the ways in which technology can be used to
promote peacebuilding?

- What can we learn from the successes and failures of ODR?


IMPORTANT DATES:

- The conference on June 3-4, 2009 will be comprised of
several formats, including round table discussions,
panels and lectures. Roundtable participants will be
required to submit final summaries of a 1000 words, while
panel participants will be required to submit full
papers.

- 500 word abstracts containing full name, affiliation and

JOURNAL OF COURT INNOVATION


The Journal of Court Innovation is soliciting articles
concerning the future of commercial litigation and e-
discovery. Articles can concern the federal or any state
justice system and there is no page length requirement.

Articles will be published in conjunction with the New York
State Judicial Institute Colloquium on the Future of
Commercial Litigation: Developing a Cost-Efficient Judicial
Process for the Electronic Age. Chief Justice Judith Kaye
will open the event and will be followed by distinguished
members of the judiciary, the bar and the educational
academy.


ABOUT THE JOURNAL:

The Journal of Court Innovation is a peer reviewed journal
that is a combined effort between the New York State
Judicial Institute (White Plains, NY), the Center for Court
Innovation (New York) and Pace Law School (White Plains,

THE ROLE OF CONGRESS IN THE 21ST CENTURY

Boston University School of Law will hold a conference on
The Most Disparaged Branch: The Role of Congress in the
21st Century on November 14-15, 2008. It will be the third
in a series of conferences at BU that began with The Role
of the Judge in the 21st Century and continued with The
Role of the President in the 21st Century. Jeremy Waldron
will give the keynote address on November 14 and Lawrence
Lessig will give a lunch address on November 15. The Boston
University Law Review will publish the papers and
proceedings.


OVERVIEW:

If the judiciary has been called "the least dangerous
branch," and the executive "the most dangerous branch,"
then surely Congress has been "the most disparaged branch"
(or "the least respected branch"). What is more, there is
considerable talk of failure in the air these days -
including constitutional failure, moral failure, political
failure and institutional failure - and criticisms of
Congress figure prominently in this discourse. Is Congress
up to the challenge of meeting the daunting problems that
it will face in the 21st Century? Are there plausible and
attractive reforms that might better equip it to face these
problems? The conference will include the following
panels, taking up issues of the sort described below.

Below are working descriptions of the topics for each panel:

I. Is Congress "The Broken Branch"?

Many observers have disparaged Congress as "the broken
branch" (e.g., Thomas Mann and Norman Ornstein's book of
that name) or portrayed it as an increasingly dysfunctional
and ineffective institution (e.g., Sanford Levinson's book,
Our Undemocratic Constitution). What about Congress is
broken? What are the most feasible and desirable proposals
for repairing and improving Congress to make it a more
effective institution (e.g., Larry Sabato's book, A More
Perfect Constitution)?

II. Is Legislation an Unprincipled, Incoherent,
Undignified Mess?

Just as Congress is viewed as "the broken branch,"
legislation itself is commonly disparaged as an
unprincipled, incoherent, and undignified mess (to recall
Jeremy Waldron's book, The Dignity of Legislation). Are
there other plausible pictures of legislation that portray
it as more defensible? A new journal, Legisprudence, "aims
at contributing to the improvement of legislation by
studying the processes of legislation from the perspective
of legal theory". What are the aspirations and prospects of
"legisprudence"? What has it contributed, and might it
contribute, to the improvement of legislation?

III. Is Congress Capable of Conscientious, Responsible
Constitutional Interpretation?

In 1893, James Bradley Thayer presumed that Congress was
the primary constitutional interpreter and that it had the
institutional capacity to discharge that responsibility. He
warned that aggressive judicial review would debilitate the
political process and, by implication, the capacities of
Congress to engage in conscientious, responsible
constitutional interpretation. By the 21st Century, has
what Mark Tushnet has called "judicial overhang" so stunted
Congress's capacities in this respect that courts should no
longer defer to Congress? Indeed, can widespread
disparagement of Congress's capacities for constitutional
interpretation readily coexist with judicial deference to
Congress? Or does it lead to more aggressive judicial
review (as may have been the case with the Rehnquist Court
and perhaps now the Roberts Court)? What is the most
defensible conception of Congress's responsibilities with
respect to constitutional interpretation and of its
capacities to carry out those responsibilities?

IV. Beyond Legislatures: Social Movements, Social Change,
and the Possibilities of Demosprudence

Scholars commonly question whether courts can bring about
social change (e.g., Gerald Rosenberg's The Hollow Hope,
Ran Hirschl's Towards Juristocracy, and Michael Klarman's
From Jim Crow to Civil Rights), perhaps implicitly assuming
that legislatures can do so. But is Congress capable of
bringing about social change? Some scholars have argued for
shifting the focus beyond legislatures (or "electocracy")
to reviving the role of the people, especially mobilized
constituencies, through social movements in pursuing social
change. Along these lines, Lani Guinier and Gerald Torres
have begun to develop a "demosprudence" of social
movements. What are the possibilities and prospects of
demosprudence?

V. Toward a More Democratic Congress?

Scholars frequently fret about how undemocratic courts are,
perhaps implicitly assuming that legislatures are
adequately or appropriately democratic. But how democratic
is Congress? And what is the best theory of how democratic
Congress should be? Are there plausible and attractive
changes in institutional design that might make it more
appropriately and defensibly democratic (consider, e.g.,
the criticisms and proposals in Levinson's Our Undemocratic
Constitution and in Sabato's A More Perfect Constitution).
Here we should distinguish between institutional design
writ small (e.g., Adrian Vermeule's book, Mechanisms of
Democracy) and institutional design writ large (e.g.,
Levinson's and Sabato's books).

VI. Toward a More Responsible Congress?

How responsible (as distinguished from responsive) is the
Congress? What is the best theory of the democratic
responsibility of Congress? Are there plausible and
desirable reforms that might make Congress more
responsible? Vis-a-vis the President? Vis-a-vis the courts?
Vis-a-vis the people themselves? Do arguments for a more
responsible Congress presuppose realistic or feasible
conceptions of how Congress operates and is likely to
operate?

VII. Congress in Comparative Perspective

Do legislatures in other countries suffer disparagement
similar to that of Congress? What about state legislatures
within the United States? Do these other legislatures have
features that make them more democratic? More effective?
More responsible? What can we learn about improving
Congress and legislation in the 21st century through
comparative inquiry?

SUMMER RESEARCH SEMINAR:

BORROWING TO THE BRINK: CONSUMER DEBT IN AMERICA


Applications are being accepted to participate in the
University of Iowa's Obermann Center for Advanced Studies
Summer Research Seminar. The 2009 seminar, Borrowing to the
Brink: Consumer Debt in America, will be directed by
Katherine Porter, Associate Professor, University of Iowa
College of Law. The seminar will produce a collection of
empirical papers that originate from the 2007 Consumer
Bankruptcy Project, a random national sample of consumer
debtors. The Seminar invites applications from scholars in
all fields, including but not limited to anthropology,
business, economics, law, public health, psychology, and
sociology.


SEMINAR DETAILS:

To provide a foundation on the data, there are three
invited participants: Robert Lawless of University of
Illinois College of Law, Dr. Deborah Thorne of Ohio
University, and Elizabeth Warren of Harvard Law School. Up
to 6 fellowships are available for interested scholars to
join the seminar. Fellowship support consists of a $2,250
stipend, plus up to $1,250 to cover travel, housing, and
per diem for the duration of the seminar.


PAPER SUBMISSIONS:

Interested applicants should be ready to produce an
original work for publication in a volume that will emerge
from the Seminar. Successful applicants will be given
access to the 2007 Consumer Bankruptcy Project data in
advance of the Seminar for use for preparing their paper in
advance of the Seminar. The Seminar itself will be used to
workshop the papers, discuss shared readings, and attend
presentations on consumer debt. The seminar will be held
June 7-15, 2009 in Iowa City, Iowa.

- Analyzing, planning, and directing the development of

- Coordinating all aspects of programs with other law
school departments including: Admissions, Career
Services, Student Services, Business Office, Information
Technology, Communications, Center for the Study of Law,
Science and Technology and the Indian Legal Program.
- Directing the marketing and recruitment efforts for all
post-graduate programs.
- Promoting the College's programs locally, nationally, and
internationally through meetings and presentations
targeted to specific individuals and groups.
- Admninistering program operating budgets and assisting in
the development of annual budget.
- Serving as College of Law liaison with University
personnel, department chairs, faculty, non-university
personnel, students, and the legal community.
- Overseeing and participating in the hiring, training,

DAYS AND SCHEDULE:

Monday-Friday 8:00AM-5:00PM, with occasional evening/

MINIMUM QUALIFICATIONS:

Bachelor's degree in a field appropriate to the area of
assignment AND eight years of related administrative
experience, which includes five years of supervisory
experience; OR, Any equivalent combination of experience
and/or education from which comparable knowledge, skills
and abilities have been achieved.


DESIRED QUALIFICATIONS:

Knowledge and experience in developing and implementing
LL.M. and MLS programs at a law school. Knowledge of
methods, principles and practices in: marketing and
promotion; online program development; management and
supervision; strategic planning; project management; budget
management; program design development and administration.
Experience in admissions procedures. Effective
communication (verbal and written) including presentations
and public speaking. Entrepreneurial, forward-looking,
