Subject: New Decisions

 

Dear Colleagues,

Several new appellate decisions have recently been released:

1) The SCC has released a trilogy of cases dealing with the interplay of non-delegable duty and vicarious liability, see M.B. v. British Columbia; E.D.G. v. Hammer; K.L.B. v. British Columbia at http://www.lexum.umontreal.ca/csc-scc/en/rec/index.html;

2) The PC has released another decision dealing with undue influence, see http://www.privy-council.org.uk/files/other/dailey.rtf;

3) The HCA has released a decision dealing with negligence, causation, and warning signs (in relation to fold up cinema seating, exam anyone?), see http://www.austlii.edu.au/ au/cases/cth/high_ct/2003/61.html;

4) The Ont C.A. has released a decision dealing with interference with prospective economic relations and illegality (which appears to be wrongly decided as a matter of basic private law principle, at least in my opinion), see http://www.ontariocourts.on.ca/ decisions/OntarioCourtsSearch_VOpenFile.cfm ?serverFilePath=d%3A%5Cusers%5C ontario%20courts%5Cwww%5C decisions%5C2003%5Cmay%5CreachC32896%2Ehtm.
