Subject: [RDG] backwards tracing in Jersey

Bill Swadling draws to my attention that the Jersey Court of Appeal has dismissed an appeal from the decision of the Royal Court that was mentioned on the RDG last year. In Federal Republic of Brazil v. Durant International Corp [2013] JCA 071, online at

the CA affirmed the Royal's Court's decision to permit backwards tracing in appropriate cases. A client briefing note from one of the firms of solicitors involved, at

states that it is "unknown" whether there will be an appeal to the Supreme Court.
