Dear Colleagues
I write to give you notice of a seminar at UCL on 11 February from 6 to 7.30, on 'Recovering Overpaid Tax: The Shifting Role of the ECJ'. The seminar will be chaired by Monica Bhandari (UCL), and two papers will be given, by Rebecca Williams (Oxford) and Max Schlote (One Essex Court). They will consider the way in which the ECJ has changed its attitude in overpaid tax cases, moving from the position that it is a matter for member states to shape their domestic law to give effect to the San Giorgio right of recovery to the position that the ECJ itself can appropriately decide some basic questions, e.g. about defences and interest. The seminar is open to all, and will be a treat for unjust enrichment lawyers, not to mention those with an interest in EC law and tax law. Further details and registration are here:
