Subject: [RDG] Kiefel J. on change of position

RDG members who were at the congress of the International Academy of Comparative Law last week will have seen that Madam Justice Kiefel of the High Court of Australia spoke on the panel that addressed judicial independence. 
Justice Kiefel gave the 2013 WA Lee Lecture in Equity in Brisbane last year under the title "Lessons from a 'Conversation' about Restitution". This text is now available at

It addresses the availability of the change of position defence in Australian law, but does so through a larger inquiry that encompasses the overall nature of restitutionary liabilities, with attention to comparative law scholarship.
