This ‘save the date’ email is to inform list members that a seminar centred on a paper by Prof. Nils Jansen (Münster) will take place at the University of Edinburgh in the afternoon of Friday 26 February 2016. Entitled,
rather provocatively, ‘Farewell to unjustified enrichment?’, the paper will argue that the concept of a unified law of unjust(ified) enrichment is a 19th century idea which has shown itself to be unworkable. The bulk of its current content should be returned
to either contract or delict.
Prof. Jansen’s paper focuses on German law and civilian legal history but it goes without saying that the argument is of great significance for other legal systems, including common-law ones. It would therefore be
excellent if we could have a strong turnout of scholars from England as well as Scotland (and potentially further afield) for the occasion.
I shall write again with further details nearer the time. For now, if anyone is eager to give a response to the paper, I would be pleased to hear from them. Given the nature of the topic I will naturally leave very
ample time for discussion, and it would be good if this started with a few structured responses from a variety of perspectives.
