Peter Birks notes that the Polly Peck decision

ought to be cross-referenced to FORTEX GROUP LTD V MACINTOSH NZ CA (FIVE JUDGES) 30 MCH 1998, which also refuses to use the remedial constructive trust to disturb the law of insolvency as it has been known and used.

If anyone knows of a good web site for NZ decisions, I would be glad to have it.
