mentioning that in his speech in Kleinwort Benson today, Lord Goff gave
him and Prof Birks a very honourable mention:
"In 1802 Sir William Evans published an Essay on the Action for Money
Had and Received. (This has since been published in [1998] R.L.R., the
text having been prepared for publication by Professor Peter Birks and
Dr. Lionel Smith of Oxford University; copies were helpfully supplied
by Professor Birks to Members of the Appellate Committee and to Counsel
shortly before the hearing of the present appeals.)"

reading)
Later in his speech, Lord Goff comments with approval that "judges are
able to welcome the assistance which they receive from a number of distinguished
writers" on the subject of the law of restitution of unjust enrichment.
Indeed, such comments are a leitmotiv of the speech. The above is therefore
just one nugget among many from the academic world which feature in the
speeches.
