A new case on mistake of law (Deutsche Morgan Grenfell Plc -and- (1) The Commissioners of Inland Revenue (2) HM Attorney General - 18 July 2003):

"The parties agree that a claim for compensation or restitution of the nature which the CJEC said in Metallgesellschaft/Hoecsht should be available would almost certainly be a claim in tort or contract and subject to a six years time limit" (para 8)

Confusion continues.
