Finkelstein J's excellent judgment in Spangaro v Corporate Investment Australia Funds Management Ltd [2003] FCA 1025 (26 September 2003) is expressly ground upon the existence of a principled law of unjust enrichment. It includes a discussion on leapfrogging. There is also something in there for those who may be sad to see unjust factors go: see paras [48] and [51]. The compendious judgment is well worth reading. To those who do not know him, Finkelstein J is one of the most well respected members of the Federal Court of Australia.
