Auckland Harbour Board, Change of Position

 

Just a quick question - does anybody know of any Commonwealth authority to the effect that a defendant can rely on change of position as a defence to an Auckland Harbour Board claim? I can find only local authority cases where the defence has succeeded (Eastbourne v. Foster for example) but a central government case would be helpful.
