Chirnside v Fay, a decision of the NZSC which was posted on the ODG yesterday by Geoff Mclay, will also interest members of the RDG. It concerns a breach of fiduciary duty by a joint venturer, was decided in the lower courts by the award of a compensatory remedy, but has been reanalysed as a claim for a gain-based remedy by the NZSC.
