Standard usage in contemporary US legal talk derives from an article from Calabresi in which he names rules which lead to loss-based awards against a wrong-doer as damage rules, and those which lead to gain-based awards as property rules: the article and proposed usage was addressed to the US law-and economics community, which greeted the differentiation as a world-class discovery and the naming with awe.
