I learned about it from Rick Bowes at the 30th Annual Workshop on Commercial and Consumer Law. I do hope those who were eligible registered. My colleague William Tetley has just sent me the copy of the letter he received from Arthur Andersen on this matter, and if I am reading it correctly, the settlement pool was US$2.7 million in respect of 3,612 unauthorized downloads. This means that those whose rights were so wantonly violated get US$750.07 per download. In Bill's case there was only one download, hence $750.07. It does make me wish that my own copyright had been breached. The Court appears to have accepted that it was unattractive that the extent of recovery should depend on whether or not the payment had been accompanied by a representation. The plea of estoppel succeeded only to the extent that the defendant had suffered actual detriment (arising from the insolvency of its contractual counterparty).
