As you can see from the following, = the English Reports have now been added to the COMMONLII site and are freely = available online.

Naturally I will be adding links to = relevant cases from my restitution site, over the next few weeks. If anyone = has any particular suggestions of pre-1874 cases for inclusion, feel free to mention them by e-mail, either to the RDG or to me personally. =

Subject: [BILETA-NEWS] = Access to English Reports 1220 - 1873, Case citator

AustLII have made access available to English Reports from 1220 to 1873.
These are currently in pdf format but some OCR processing has been = done
so that there is the basis of searching. We expect the LII community = to
further develop this resource as funding becomes available. This = access
was made possible through collaboration with JUSTIS. Free access = to the
English Reports 1220-1873 is at: <http://www.commonlii.or= g/int/cases/EngR/>

Further, there is a new case citator available at AustLII which = improves
the research process and the quality of search results. This is a = very
significant development of a research tool within the LII community.

Earlier this month the Supreme Court of Canada released Conf=E9d=E9ration des syndicats nationaux v. Attorney General of Canada: http://www.canlii.org/en/ca/scc/doc/2008/2008scc68/2008scc68.html The case involved the collection of premiums by the federal government for unemployment insurance. In three fiscal years, the power to set the premium= s was delegated by legislation to the G-G in Council. The Court held that thi= s delegating legislation was inadequate inasmuch as it did not state explicitly that Parliament was delegating its taxing authority. The result was that all the money collected during those three years (no doubt some billions of dollars ... every Canadian with income pays into the system) wa= s a form of taxation without Parliamentary authority. The effect of the judgment was, however, suspended for one year, on the ground that the case involved "the improper exercise of a power conferred on Parliament".
