Doctors' duties
The
Court of Appeal did consider briefly a football club bringing a
claim for damages for loss of a player in Middlesbrough v. Liverpool
[2002] EWCA Civ 1929, the Christian Ziege poaching case, when Liverpool
had alleged that a such a claim was so fanciful as to merit summary
judgment.

I'm
all in favour of hypotheticals offered to me as the basis of exam
questions. But really ... the thought of WBA claiming loss of chance
of beating Man Utd? Let's keep some sense of reality about all of
this. A few dodgy results in recent times against a couple of sides
- in some cases almost as good as Sainsbury’s second eleven
--- and people go running away with the preposterous notion than
Man Utd could conceivably be defeated by WBA.
