CALL FOR PAPERS

The University of Amsterdam organises from 18 - 20 October 2000 in commemoration of Prof. Marcel Henri Bregstein (1900 - 1957 ) an international congress on " Unjust Enrichment and The Law of Contract within the context of the European Private Law".The participants will arrive in Amsterdam the course of Wednesday the 18th of October 2000 and the opening session will be held in the late afternoon in the Aula Magna of the University of Amsterdam. On Thursday the 19th and Friday the 20th plenary sessions and workshops will be held in the premises of the Royal Academy of Sciences.

The working sessions will be held around the following themes:

  • unjust enrichment and international private law
  • the right to contribution or recoupment , when the plaintiff discharged another's liability.
  • Compensation for services rendered by public authorities
  • Restitution and the law of the sea: the right to maritime salvage reward
  • Payment of withdrawn or forged cheques
  • Unjust enrichment during pre-contractual negotiations or the doctrine of entire contracts
  • Compensation for improvements made by tenants; ius tollendi and/or compensation
  • Should the house-owner compensate his or her fiancé (e) for labour and expenses made during their unmarried cohabitation
  • The influence of damages paid by a third party upon the maximum of the indemnification as agreed upon in the insurance policy
  • Turpitudinem suam allegans nemo auditur or: nobody comes to court but with clean hands;restitutionary claims and illegal contracts
  • Possible defences:change of position
  • (Criminal Law) forfeiture of the proceeds of crimes and other benefits accruing to the criminal.

Those who wish to contribute a paper to any of these working sessions are kindly invited to send an abstract of their proposed paper to the organiser of this Congress
